New Call Back Language
There has been some confusion as to how the new contract language is interpreted in regards to "Call Back". There are two types of overtime defined in our contract. Voluntary(Article 15.4)and "Call Back"(Article 15.6). A Call Back is defined as an unscheduled work assignment that does NOT immediately proceed or follow your scheduled work hours.
The Unions position is that when you are called between your normal work hours and either asked or told to report to work, you will receive the call back minimum of 4 hours. The main reason the new language was added to the contract is to allow the City to declare an emergency or immediate need that would "require" an employee to come in for call back - unless they had "good cause". Nothing has changed regarding the minimum 4 hours of call back pay for UNSCHEDULED OT. As a matter of fact, only the Appointing Authority or "designee" can declare an urgent or immediate need and management will be bound to the OT distribution practice pursuant to Article 15.4(D) when they declare that need.
